1. INTRODUCTION AND AGREEMENT TO TERMS
1.1. About These Terms. These Terms and Conditions ("Terms") constitute a legally binding agreement between you, whether personally or on behalf of an entity ("you," "Patient," or "User"), and KER 4 ME (Pty) Ltd ("KER 4 ME”," "we," "us," or "our"), concerning your access to and use of the KER 4 ME website, mobile application, and related services (collectively, the "Platform").
1.2. Acceptance of Terms. By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, POPIA Notice, and any additional terms referenced herein. If you do not agree to all of these Terms, you are expressly prohibited from using the Platform and must discontinue use immediately.
1.3. Amendments. We reserve the right to amend these Terms at any time. Any material changes will be communicated to you, and the updated Terms will be effective immediately upon posting. Your continued use of the Platform after such amendments constitutes your acceptance of the revised Terms.
1.4. Definitions. In these Terms, the following definitions apply:
· "Healthcare Provider" means any licensed doctor, dentist, specialist, clinic, or hospital listed on the Platform.
· "Services" means the facilitation and intermediary services provided by KER 4 ME (Pty) Ltd, including connecting you with Healthcare Providers.
· "Transaction Value" means the total amount charged by the Healthcare Provider for medical services.
· "Service Fee" means the fee charged by KER 4 ME (Pty) Ltd for facilitating the connection, calculated as a percentage of the Transaction Value.
2. NATURE OF OUR SERVICES AND DISCLAIMER
2.1. Platform as Intermediary. KER 4 ME (Pty) Ltd is a technology platform that facilitates connections between travelling patients (international, interprovincial and trans-district) and Healthcare Providers in South Africa. We act as an intermediary or broker and are not a healthcare provider.
2.2. No Medical Services. We do not provide medical advice, diagnosis, or treatment. Any information on the Platform is for general informational purposes only and is not a substitute for professional medical consultation. The decision to undergo any treatment and the provision of all medical services is solely between you and the chosen Healthcare Provider.
2.3. No Endorsement. While we vet Healthcare Providers according to our selection process, we do not warrant or make any representations regarding the quality, suitability, or outcomes of services rendered by Providers. Display on our Platform does not constitute an endorsement or warranty of quality by us.
2.4. Emergency Situations. The Platform is not intended for medical emergencies. If you are experiencing a medical emergency, please contact your local emergency services immediately.
2.5. Scope of Services. Our platform facilitates bookings for:
· Medical consultations and procedures (e.g., GP visits, specialist appointments, dental care, surgeries);
· Beauty treatments (e.g., facials, nails, lashes, waxing);
· Spa and wellness services (e.g., massages, body wraps, relaxation packages);
· Medical Concierge Service (enhanced coordination including travel, accommodation, visa support, and post‑treatment follow‑up).
3. PATIENT RESPONSIBILITIES AND OBLIGATIONS
3.1. Accurate Information. For medical concierge services, you agree to provide complete, accurate, and truthful information in all inquiries and bookings, including your medical history, current medications, allergies, and personal details. Failure to do so may result in adverse health outcomes for which KER 4 ME (Pty) Ltd bears no liability.
3.2. Disclosure of Medical Information. You undertake to:
· Disclose all relevant information to your Healthcare Provider, including unexpected changes in your condition, new symptoms, or increased pain.
· Consult with your Healthcare Provider before self-medicating or seeking alternative therapies that might interfere with your ongoing treatment.
· Keep your home doctors informed about your treatment plans.
3.3. Independent Verification. You are solely responsible for verifying the credentials, experience, and suitability of any Healthcare Provider. We recommend verifying registration with the Health Professions Council of South Africa (HPCSA) or relevant professional bodies.
3.4. Compliance with Laws. You must comply with all South African laws, including:
· Visa requirements for medical treatment
· Customs and import regulations
· Any specific requirements related to your treatment
3.5. Cultural Sensitivity. You agree to make an effort to understand and accept cultural differences, show respect and courtesy to all healthcare workers, and clearly communicate your wants and needs.
3.6. Appointment Attendance. You are responsible for keeping your scheduled appointments. If you are unable to do so, you must notify KER 4 ME (Pty) Ltd and your Healthcare Provider immediately. Failure to attend may result in forfeiture of deposits or cancellation fees as outlined in your booking confirmation.
3.7. Post-Treatment Responsibility. If you choose to discontinue treatment, transfer your care to another physician, or act against medical advice, you may not hold KER 4 ME (Pty) Ltd, the Healthcare Provider, or any associated facility responsible for any consequences of your decision.

4. BOOKING, PAYMENT, AND SERVICE FEES
4.1. Booking Process. All bookings must be made through KER 4 ME’s official channels. A booking is confirmed only when you receive written confirmation from us.
4.1.1 How bookings work. You search for a Provider, select a service, and book an appointment through our platform. The Provider’s Base Price (the amount they charge) is displayed clearly.
4.1.2. Platform Service Fee. KER 4 ME (Pty Ltd) add a service fee to your total payable amount. The service fee is:
Type of Booking Service Fee:
Standard booking (any healthcare, beauty, or wellness service): 8.3%
Medical Concierge Service*: 12%
Medical Concierge Service includes personalised care coordination, travel logistics, accommodation booking, visa assistance, 24/7 patient support, and post‑treatment follow‑up. This service is clearly identified at the time of booking.
4.1.3. Total Transaction Value. Total payable by you = Base Price + Platform Service Fee. The total is shown before you confirm the booking.
4.1.4. Payment. You pay the total amount securely through our platform. We accept credit/debit cards and other payment methods specified at checkout.
4.1.5. No hidden fees. No additional charges are added by us. Providers may have their own cancellation or deposit policies, which are disclosed before booking.
4.2. Pricing.
All prices displayed are in South African Rand (ZAR) unless otherwise stated. Prices are subject to change and will be confirmed at the time of booking.
4.3. Payment Terms.
· Payment must be made in accordance with the payment schedule provided at the time of booking
· We accept payment by credit card, debit card, or electronic funds transfer (EFT)
· Your booking will not be finalized until payment is received in full
· Receipts and tax invoices will be provided
4.4. Medical Aid / Insurance Claims.
· If you intend to claim from medical aid or travel insurance, please select this option at booking
· Should your claim be rejected for any reason, you remain personally liable for all fees
· Any unpaid fees will be pursued in accordance with South African law
4.5. Currency and Exchange Rates. International payments may be subject to currency conversion rates. KER 4 ME (Pty) Ltd is not responsible for any fluctuations in exchange rates or fees imposed by your financial institution.

5. CANCELLATIONS, REFUNDS, AND RETURNS POLICY
(In Compliance with the Consumer Protection Act)
5.1. General Refund Rights Under the CPA. Under the Consumer Protection Act 68 of 2008, consumers have certain statutory rights regarding refunds. These Terms do not limit or exclude any rights conferred by the CPA.
5.2. Right to Cancel a Booking.
· Cooling-Off Period: If you cancel within the cooling‑off period, the Service Fee is refunded in full.
· General Cancellation: Cancellation by you outside cooling‑off period
Cancellation terms depend on the Provider’s policy, which is shown before booking. Typical policies:
· Cancel at least 24 hours before appointment: full refund of Base Price (Service Fee may be non‑refundable – we will refund the Service Fee at our discretion if you are not at fault. );
· Cancel less than 24 hours before: Provider may charge a cancellation fee;
· No‑show: no refund.
5.3. Right to Refund for Unsatisfactory Services.
In terms of Section 56 of the CPA, you have the right to return unsafe or defective goods within six months of delivery for a refund, replacement, or repairHowever, this right applies differently to services:
· For medical services rendered, disputes regarding quality or outcome must be addressed directly with the Healthcare Provider.
· The Service Fee charged by KER 4 ME is not refundable once we have performed our facilitation services.
5.4. Refunds for Medical Services.
· Any refunds for medical treatment are the sole responsibility of the Healthcare Provider
· KER 4 ME (Pty) Ltd will facilitate refund requests but does not guarantee outcomes
· Disputes regarding medical outcomes must be resolved directly with the Healthcare Provider or their insurer.
5.5. Exclusions from Refunds. Refunds are not available for:
· Services already performed (e.g., completed consultations or procedures)
· Changes in medical condition that affect suitability for treatment
· Patient non-compliance with pre-operative or post-operative instructions
· Situations where inaccurate medical information was provided
5.6. Refund Process. To request a refund:
1. Submit a written refund request to info@ker4me.com within the applicable timeframes
2. Provide all relevant documentation (booking confirmation, payment proof, correspondence with Healthcare Provider)
3. Allow 30 business days for processing.
5.7. Non-Refundable Service Fee.
The Service Fee (commission) charged by KER 4 ME (Pty) Ltd is non-refundable once we have successfully facilitated the connection and booking, unless the cancellation occurs within the cooling-off period or is due to our error.

6. MANDATORY INSURANCE REQUIREMENTS – INTERNATIONAL PATIENTS
6.1. Travel and Medical Insurance.
All international patients using KER 4 ME's services are required to obtain comprehensive travel and medical insurance that covers:
· Medical complications arising from procedures performed in South Africa
· Emergency evacuation and repatriation
· Trip cancellation or delays
· Extended stay due to medical complications
6.2. It is non-mandatory for South African patients using our platform to have medical insurance or medical aid cover.
6.3. Proof of Insurance.
You may be required to provide proof of insurance before your booking is finalized.
6.4. Insurance Disclaimer.
KER 4 ME (Pty) Ltd does not sell insurance and is not responsible for any claim denials by your insurer. You are responsible for understanding your policy's terms and exclusions.
7. LIABILITY AND INDEMNIFICATION
7.1. Limitation of Liability.
To the maximum extent permitted by South African law, KER 4 ME (Pty) Ltd, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, or consequential damages arising from:
· Your use of the Platform or reliance on any information contained within it
· Any medical treatment, advice, or action by a Healthcare Provider
· Any complications, outcomes, or dissatisfaction arising from medical services
· Travel arrangements, delays, cancellations, or issues with third-party service providers
· Any events beyond our reasonable control (force majeure).
7.2. "As Is" and "As Available" Disclaimer.
The Platform is provided on an "as is" and "as available" basis. We make no warranties or representations regarding:
· Uninterrupted or error-free access to the Platform
· The accuracy, reliability, or completeness of information on the Platform
· The availability or suitability of any Healthcare Provider
7.3. Indemnification.
You agree to indemnify and hold KER 4 ME (Pty) Ltd harmless from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from:
· Your misuse of the Platform
· Your breach of these Terms
· Your violation of any applicable laws or regulations
· Your receipt of medical services from any Healthcare Provider
· Any disputes between you and a Healthcare Provider
7.4. Medical Tourism Risks. You acknowledge that medical tourism involves inherent risks, including but not limited to:
· Complications from surgery or treatment
· Travel-related health risks
· Language and cultural barriers
· Differences in medical standards and protocols
· Challenges with follow-up care after returning home
By using our Services, you voluntarily assume these risks.
8. INTELLECTUAL PROPERTY RIGHTS
8.1. Medical visa
If you are an international patient (travelling from outside South Africa) and you require medical treatment that involves a hospital stay or invasive procedure, you may need to obtain a medical visa before travelling.
It is your sole responsibility to:
· Check visa requirements with the South African Department of Home Affairs or your nearest SA embassy;
· Apply for the correct visa in good time;
· Provide any supporting documents (e.g., appointment confirmation, letter from the Provider).
8.2. No visa required for South African residents.
If you are a South African citizen or permanent resident travelling within South Africa, you do not need any medical visa. You may book and receive services anywhere in the country with only your valid ID.
8.3. Assistance.
For International Patients who book the Medical Concierge Service, we can provide visa invitation letters and assist with documentation. For standard bookings, we do not provide visa support.
9. USER CONDUCT AND PROHIBITED ACTIVITIES

9.2. Limited License.
You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes. You may not:
· Copy, reproduce, modify, or distribute any content without prior written consent.
· Use automated tools (bots, scrapers) to access the Platform.
· Reverse engineer any part of the Platform.
9.3. Trademarks. " KER 4 ME (Pty) Ltd " and related logos are trademarks of KER 4 ME (Pty) Ltd. You may not use these marks without our prior written permission.
10. USER CONDUCT AND PROHIBITED ACTIVITIES
10.1. Permitted Use.
You agree to use the Platform only for lawful purposes and in accordance with these Terms.
10.2. Prohibited Activities.
You agree not to:
· Use the Platform for any unlawful, fraudulent, or harmful purpose
· Post false, misleading, or defamatory information about Healthcare Providers
· Interfere with the security or functionality of the Platform
· Attempt to circumvent the Platform by contacting Providers directly to avoid the Service Fee
· Upload or transmit viruses, malware, or harmful code
· Impersonate any person or entity.
10.3. Monitoring and Enforcement.
We reserve the right to:
· Monitor your use of the Platform
· Remove any content that violates these Terms
· Suspend or terminate your access without notice for violations
11. ACCOUNT REGISTRATION AND SECURITY
11.1. Account Creation.
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration.
11.2. Account Security.
You are responsible for:
· Maintaining the confidentiality of your account credentials
· All activities that occur under your account
· Notifying us immediately of any unauthorized access
11.3. Account Suspension.
We reserve the right to suspend or terminate accounts that violate these Terms or pose a security risk.
12. THIRD-PARTY SERVICES AND LINKS
12.1. External Links.
The Platform may contain links to third-party websites, including those of Healthcare Providers, travel services, and accommodation providers. We are not responsible for the content, policies, or practices of these third parties.
12.2. Independent Contractors.
Healthcare Providers are independent contractors and not employees, agents, or partners of KER 4 ME (Pty) Ltd.
12.3. Service Providers.
We use third-party service providers (e.g., payment processors, hosting services) to operate the Platform. These providers have their own terms and privacy policies.
13. PRIVACY, POPIA, AND DATA PROTECTION
13.1. Privacy Policy.
Your privacy is important to us. The collection, use, and protection of your personal information is governed by our Privacy Policy and POPIA Notice, which are incorporated into these Terms by reference.
13.2. Health Information.
As a special category of personal information, your health data receives additional protections under POPIA. We process such data only with your explicit consent and for the purposes of facilitating your medical journey.
13.3. Data Processing.
By using our Services, you consent to the transfer of your medical records to Healthcare Providers you choose to consult and to third-party service providers as necessary to fulfil your booking.
13.4. Information Officer.

14. TERMINATION
14.1. Termination by You.
You may terminate your account at any time by contacting us.
14.2. Termination by Us.
We may terminate or suspend your access to the Platform immediately, without notice, for any violation of these Terms or for any reason that compromises the security or integrity of the Platform.
14.3. Survival.
Sections relating to liability, indemnification, intellectual property, and dispute resolution shall survive any termination.
15. GOVERNING LAW AND DISPUTE RESOLUTION
15.1. Governing Law.
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa.
15.2. Dispute Resolution.
Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the South African courts. However, we encourage you to contact us first to seek an amicable resolution.
15.3. Consumer Protection.
Nothing in these Terms limits your rights under the Consumer Protection Act, which may provide additional protections.
16. GENERAL PROVISIONS
16.1. Entire Agreement.
These Terms, together with our Privacy Policy and any booking confirmations, constitute the entire agreement between you and KER 4 ME (Pty) Ltd
16.2. Severability.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16.3. Waiver.
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
16.4. Assignment.
You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
